ResvoMe - Simple booking tool for service providers

Welcome to ResvoMe. These Terms of Service ("Terms") govern your use of the ResvoMe platform and services. By accessing or using ResvoMe, you agree to be bound by these Terms.

1. Definitions

"ResvoMe," "we," "us," or "our" refers to ResvoMe and its platform.
"Service Provider" means any business or individual who creates an account to offer appointment-based services (such as barbers, salons, trainers, massage therapists, etc.).
"Client" means any individual who books appointments through the ResvoMe platform.
"Platform" means the ResvoMe website, applications, and all related services.
"Services" means the appointment scheduling, management, and related features provided by ResvoMe.
"User Content" means any content, data, or information submitted by users.

2. Service Description

ResvoMe provides an online appointment scheduling platform that enables Service Providers to manage bookings, send automated reminders, and maintain waitlists. Clients can book, reschedule, and cancel appointments through unique booking links without creating accounts.

3. Account Registration and Eligibility

3.1 Service Provider Accounts

You must be at least 18 years old and capable of forming binding contracts.
You must provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your account credentials.
You must notify us immediately of any unauthorized use of your account.
One account per Service Provider business is permitted.

3.2 Client Usage

Clients do not need accounts to book appointments. By booking an appointment, Clients agree to these Terms and consent to receive service-related communications.

4. Acceptable Use Policy

4.1 Permitted Uses

ResvoMe may be used by legitimate service businesses including but not limited to:

Hair salons and barbershops
Beauty and wellness services
Personal training and fitness coaching
Massage therapy and spa services
Professional consultations
Any other lawful appointment-based services

4.2 Prohibited Uses

You may not use ResvoMe to:

Offer illegal services or activities
Engage in fraudulent or deceptive practices
Violate any applicable laws or regulations
Harass, abuse, or harm others
Transmit spam or unsolicited communications beyond service-related messages
Attempt to gain unauthorized access to the Platform
Interfere with or disrupt the Platform's operation
Collect or harvest user data without permission

5. SMS/Text Messaging Terms

5.1 Service Provider SMS Usage

Service Providers may only send appointment-related messages (confirmations, reminders, waitlist notifications).
Marketing messages are prohibited unless separate consent is obtained.
Service Providers must comply with all applicable laws including TCPA and CAN-SPAM.

5.2 Client SMS Consent

Clients must explicitly consent to receive SMS messages when booking.
Message frequency varies based on appointment bookings.
Message and data rates may apply.
Clients can opt-out anytime by texting STOP.
For help, Clients can text HELP or contact the Service Provider directly.

6. Waitlist Feature Terms

The waitlist operates on a first-come, first-served basis.
Waitlist notifications expire 30 minutes after sending.
ResvoMe does not guarantee waitlist conversions.
Service Providers may enable or disable the waitlist feature.
Clients joining waitlists consent to receive notification messages.

7. Subscription and Payment Terms

7.1 Free Trial

New Service Providers receive a 30-day free trial.
No credit card required to start the trial.
Full platform access during the trial period.
Trial automatically expires without payment information.

7.2 Subscription Plans

Monthly Plan: $24.99 per month
Annual Plan: $239 per year (save $60)
All plans include unlimited bookings and SMS messages
Prices subject to change with 30 days notice

7.3 Billing and Cancellation

Subscriptions automatically renew unless cancelled.
Payment processed on the same calendar day each period.
Cancel anytime through your account settings.
No refunds for partial periods.
Annual plans are non-refundable after 30 days.

8. User Content and Licenses

8.1 Your Content

You retain ownership of all content you submit. By using ResvoMe, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely to provide the Services.

8.2 Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or attribution.

9. Privacy and Data Protection

Your use of ResvoMe is subject to our Privacy Policy. Service Providers are responsible for their own compliance with data protection laws regarding their Clients' information.

10. Intellectual Property

ResvoMe and its original content, features, and functionality are owned by ResvoMe and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the Platform.

11. Third-Party Services

ResvoMe integrates with third-party services (payment processors, SMS providers, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services' actions or failures.

12. Disclaimers and Limitations of Liability

12.1 "As Is" Service

RESVOME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESVOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12.3 Total Liability Cap

Our total liability to you for all claims shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold ResvoMe harmless from any claims, damages, losses, and expenses (including attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@resvome.com to attempt informal resolution. We'll work in good faith to resolve issues within 30 days.

14.2 Binding Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration under the American Arbitration Association rules. Arbitration shall occur in Delaware, and each party bears its own costs.

14.3 Class Action Waiver

YOU AND RESVOME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14.4 Exceptions

Small claims court actions and injunctive relief for intellectual property violations are excluded from arbitration requirements.

15. Termination

Either party may terminate at any time.
We may suspend or terminate accounts for Terms violations.
Upon termination, your right to use the Platform ceases immediately.
Data may be deleted 30 days after termination unless legally required to retain.

16. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or Platform notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

17. General Provisions

Governing Law: These Terms are governed by Delaware law.
Entire Agreement: These Terms constitute the entire agreement between parties.
Severability: If any provision is unenforceable, others remain in effect.
No Waiver: Failure to enforce any right is not a waiver.
Assignment: You may not assign these Terms; we may assign freely.
